Indie production company Phame Factory has won a battle against Sony in a true David vs. Goliath fight. Flay was to be released last year, but writer, director and producer Eric Pham put the release on hold due to a squabble over the film’s antagonist. Sony’s Slender Man movie was coming up for release last August, and the company argued that Phame Factory’s Flay character was too similar to Slender Man. Sony holds exclusive rights to Slender Man, based on the creepypasta story of the faceless evil man.

"I'm now very happy to say that we obtained a very favorable resolution of this lawsuit and finally have the legal right to release our feature film”, said Pham.

As part of the settlement agreement, Phame Factory has to include a disclaimer on advertising material, trailers, and the movie itself.

Flay follows a woman who struggles to save her brother and others around her from a malevolent faceless spirit. Violett Beane of Truth or Dare and A. Michael Baldwin of Phantasm fame will star.

Phame Factory has set an April 2, 2019 release for the film.
